You have 120 days from the date you receive your MSN to file a Medicare appeal. However, if you have Medicare Advantage, you must appeal within 60 days of the coverage determination. Grievances are a different process. They address problems with the quality of care, not Medicares payment for it. Grievances must be filed within 60 days of an incident.

Your quarterly Medicare Summary Notice provides a list of covered services and supplies that have been billed to Medicare during a three-month period. On this notice, you can see the dollar amounts that were sent to Medicare, and also the amount youre responsible for paying to the service provider .

You can also use the MSN to find out if Medicare has fully or partially denied your medical claim.

This is where youll decide if an appeal is necessary. If you dont agree with any of the information on the MSN, you can file an appeal, also known as a redetermination. You must do so within 120 days of receiving the MSN that contains the charge you disagree with.

You can file an appeal in any of three ways:

  • Download and complete a Redetermination Request Form and send it to the Medicare contractor at the address listed on your MSN.
  • Send your appeal to the company handling Medicare claims . When doing this, make sure to:
  • Circle every applicable item and/or service you disagree with and put in writing why you disagree with the decision .
  • Include your name, address, phone number, and Medicare number.
  • Sign the MSN document where your signature is necessary. If your doctor or health-care provider contributed any additional information to help your case, include that as well.
  • Send a written request to the company that handles Medicare claims . When doing this, make sure to include:
  • Your name and Medicare health insurance claim number

    You will want to gather any information that could support your appeal. This could mean reaching out to your medical provider for a letter of support, if appropriate, and getting copies of appropriate medical records. Be sure to include your Medicare number on all pages of any documents you plan to submit. Also, make a copy of all documents for your own records.

    Medicare allows you to pursue an appeal in one of three ways:

    • Follow the appeals instructions included with your MSN and send a copy of the MSN and all requested documents to the company that processed your claim.
    • Complete the Centers for Medicare and Medicaid Services Redetermination Request Form and send it to the company that processed your claim.

    If your appeal reaches Level 3, your case is then heard by an Administrative Law Judge , generally by phone or video-teleconference or in some cases, in person. You also have the right to request the ALJ review the information independently and make a decision without hearing your testimony. The ALJ may decide to make a decision without hearing your testimony if he or she feels there is already enough information to reach a decision in your favor.

    In order for your case to be eligible for Level 3, it must meet a specific dollar amount, which may change from year to year. You may be able to combine claims to meet the minimum dollar amount.

    Youll send your request to the Office of Medicare Hearings and Appeals Central Operations. Youll find the appropriate address listed in the Medicare Reconsideration Notice you received in Level 2.

    At Level 2, the Independent Review Organization reviews our plan’s decision and decides if it is correct or if it should be changed. If you had a Fast Appeal at Level 1, you will have a Fast Appeal at Level 2. The time frames for a Fast and Standard Appeal at Level 2 are the same as for the initial appeal. If the answer to your Level 2 Appeal is no, it means the review organization agrees with our decision not to approve your request.

    What Is The Process For Filing An Appeal

    You have 120 days from a Medicare denial or penalty to file an appeal.

    Medicare will let you know in writing if your coverage has been denied or youve been assessed a penalty. The notice youll receive will let you know the steps you can take to file an appeal.

    In a few cases, youll file whats called a fast appeal. Fast appeals apply when youre notified that Medicare will no longer cover care thats:

    Your notice will tell you how to contact your states Beneficiary and Family Centered Care Quality Improvement Organization . The BFCC-QIO will notify the facility of your appeal and will review your case.

    In the case of a hospital, the BFCC-QIO will have 72 hours to make its decision. A hospital cant discharge you while your case is being reviewed by the BFCC-QIO.

    In the case of nursing facilities or other inpatient care settings, youll receive a notice at least 2 days before your coverage ends. The BFCC-QIO will need to make its decision by the end of the business day before youre due to be discharged.

    For all other appeals, youll need to go through the standard appeals process, which well go over next.
