Regulation Of Adult Day Care

All adult day care centers are required to have state licenses or are regulated to a degree to provide certain types of services. This is especially true of those centers that receive public funding, which most do. Most staff members receive background checks and many are certified social workers. In addition, many states regulate the staff-to-patient ratio and the minimum staff available at any time.

In adult day care, there is on average one care worker for every six participants. State regulations vary with some states as low as a 1:4 ratio and others as high as 1:10.

Although Medicare doesnât cover adult diapers, Medicare Part B does cover medical treatment for incontinence, including medical services, diagnostic tests, and doctor visits. The report, Are Older Americans Getting the Long-Term Services and Supports they Need?, found that two-thirds of Medicare beneficiaries 65+ who are aging in place at home in the community need Long Term Services and Supports . These are nonmedical benefits required to perform activities of daily life, such as eating, bathing, walking or grooming. Adult Day Health Care is one service that is included in the LTSS category.

Currently, Medicare does not cover these services. Medicare Advantage covers Adult Day Health Care as a supplemental benefit however, less than one percent of plans currently offer it. Medicaid covers LTSS, including Adult Day Health Care.

Every Medicaid program in every state has its own eligibility considerations. Generally speaking, most adult day care is provided under Medicaid waivers. Eligibility for waivers considers the applicants income and financial resources, as well as their functional ability. In most states, waivers require the participant to be in need of nursing home level care.

In 2022, most waivers limit the participants monthly income to less than $2,523. Excluding the value of their home, their countable assets are limited to $2,000 for the majority of states Applicants with resources or income in excess may be able to qualify for Medicaid by working with a Medicaid planning professional.

Eligibility for Medicaid-funded, adult day care under a Medicaid state plan is both less and more restrictive than with a waiver. Again, as with waivers, there is some flexibility when calculating what qualifies as monthly income.
